    Welcome, and thank you for your (“You” or ‘Your”) interest in UDispatch (“UDispatch,” “We,” “Us” or “Our”), Our web site (the “Site”), mobile application, and/or web based software program (collectively, the “UDispatch Platform”), as well as other services provided by Us and on which a link to this Privacy Policy (this “Policy”) is displayed shall be referred to collectively as the “Services”.


    UDispatch is dedicated to protecting Your Personal Information and letting You know how We use it. This Privacy Policy applies to transactions, activities, and data gathered through the UDispatch Platform. This Policy describes the information that We gather from You on the Service, how We use and disclose such information, and the steps We take to protect such information.


    Please review this Privacy Policy periodically as We may revise it without notice. This Privacy Policy was last revised on September 8, 2016. Each time You use the UDispatch Platform or provide Us with information, You are accepting the practices described in this Privacy Policy at that time.


    Some Capitalized terms used but not defined in this Policy have the meaning given to them in the UDispatch Terms and Conditions of Service.


    Data We Collect From You


    In order to operate the UDispatch Platform and to provide You with information about products or services that may be of interest to You, We may collect “Personal Information” (i.e. information that could be used to contact You directly — without using the UDispatch Platform — such as full name, postal address, phone number, or email address) or “Demographic Information” (i.e. information that You submit, or that We collect, that is not Personal Information. This may include, but is not limited to, zip code, hometown, gender, username, age/birth date, browsing history information, searching history information, and registration history information). We will also collect the contact information of Your friends, if You choose to connect Your contacts and address book information and Your login credentials to Your Social Network Accounts (“SNS Accounts”) such as Facebook and Twitter with Your UDispatch account.


    You represent and warrant that You have the authority to provide Us with any such contact information.


    Demographic Information is divided into two categories:


    “Non-public Information,” which consists of ride transaction information and one-on-one communications between You and other users of the UDispatch Platform; and “Public Information,” which consists of all other demographic information.


    Please note that nowhere on the UDispatch Platform do We knowingly collect, keep or maintain Personal Information from children under the age of 18, as We require that all users represent to Us that they are at least 18 years old.


    If You are under 18 years of age, then please do not use or access the Service at any time or in any manner. If You are a parent or guardian and discover that Your child under 18 years of age has obtained an Account on the Service, please alert us at [email protected] and submit a request to delete child’s Personal Data from Our systems.


    How We Use Personal Information Collected from You


    We use the information We collect on the Service in providing the Service and operating Our business, including the following:


    To operate, maintain, enhance and provide all features of the UDispatch Platform, including processing Your transactions and supporting Your activities on the UDispatch Platform. We may share Your Personal Information with Our agents, representatives, contractors and service providers so they can provide Us with support services such as email origination, receipt or support services, customer relationship management services, and order fulfillment. We require these entities to not use Your Information for any other purpose other than to understand and analyze the usage trends and preferences of Our users, to improve the Service, and to develop new products, services, features, and functionalities.


    By purchasing, registering and/or making reservations for products and services offered or sponsored by Third Parties on the UDispatch Platform, or electing to receive communications such as emails and mailed materials or electing to participate in contests, sweepstakes or other programs such as discount or rewards programs, You consent to Us providing Your Personal Information to those Third Parties and acknowledge that they may use Your Personal Information in accordance with their own Privacy Policies. You will need to contact those Third Parties to instruct them directly regarding Your preferences for their use of Your Personal Information. Additionally, You agree that We may use and disclose all such information so submitted to Third Parties in the same manner in which We are entitled to use and disclose any other information You submit to Us.


    We use Your email address and other Personal Information to help Us efficiently operate the UDispatch Platform, to contact You in connection with Your transactions and other activities on the UDispatch Platform (including, but not limited to administrative purposes such as customer service, confirmation emails, or important news that could affect Your relationship with UDispatch, or to address Intellectual Property infringement), to forward trip information to You from other Users, and to contact You and other Users to suggest potential matches. We use Your contact information to find and connect with Your friends (when instructed by You). These types of communications are known as “Operational Communications.” In some cases, Operational Communications may also contain commercial messages, such as banner ads and updates on promotions and events.


    Generally, You have the ability to opt-out of receiving any promotional communications as described below under “Choice/Opt-Out"


    We may use “cookies” information and “automatically collected” information We gather on the Service to: (i) personalize Our services, such as remembering Your information so that You will not have to re-enter it during Your visit or the next time You visit the Service; (ii) provide customized advertisements, content, and information; (iii) monitor and analyze the effectiveness of the Service and third-party marketing activities; (iv) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (v) track Your entries, submissions, and status in any promotions or other activities on the Service.


    Google Analytics: UDispatch may use Google Analytics on the Site to create user navigation reports for Our Site administrators. We take measures to protect the Technical Information collected by Our use of Google Analytics. Your Personal Data will only be used on a need to know basis to resolve technical issues, to administer the Site and identify visitor preferences. Any statistical reports or Site traffic information are exclusively accessed by authorized personnel within Our Company. We do not use any of this information to identify visitors and We do not share it with Third Parties. Google operates independently from us and has its own Privacy Policy in place, which We strongly suggest You review Google’s Privacy Policy. Google may use the information collected by Our use of Google Analytics to evaluate Users' activity on Our Site. For more information, see Google Analytics Privacy and Data Sharing.


    Any Third Party with whom We are allowed to share Your Personal Information is authorized to use Your Personal Information in accordance with Our contractual arrangements with such Third Parties and in accordance with their own Privacy Policies, over which We have no control. You agree that We are not responsible or liable for any of their actions or omissions. Those who contact You will need to be instructed directly by You regarding Your preferences on how Your Personal Information will be used by such Third Party.


    How We Use Demographic Data


    We may review all Demographic Data. We may use Public Information to enable other users to search Your profile, to determine whether Your trip details fit other user's requirements, and to communicate with You. We may use Demographic Information to tailor the UDispatch Platform and communications to Your interests. We may also share Demographic Information with advertisers on an anonymous and aggregated basis (i.e., without telling the advertisers Your identity). One of the reasons We may do this is to increase the likelihood that Our advertisers' goods and services will appeal to You as a user of the UDispatch Platform. Our sharing of Demographic Information with advertisers is anonymous (i.e., We do not tell advertisers which particular UDispatch Users are members of which demographic groups), subject to the stipulations stated in this Privacy Policy. We reiterate, however, that if You respond to a demographically-targeted ad and decide to give the advertiser Your Personal Information, then the advertiser may be able to identify You as being a member of that demographic group.


    Our Security Precautions


    UDispatch follows generally accepted industry standards to protect the information submitted to us, both during transmission and once We receive it. We maintain appropriate administrative, technical and physical safeguards to protect Personal Data against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the Personal Data in Our possession. This includes, for example, firewalls, password protection and other access and authentication controls. We use SSL technology to encrypt data during transmission through public internet, and We also employ application-layer security features to further anonymize Personal Data.


    UDispatch employs staff dedicated to maintaining Our Privacy Policy as set forth herein and other privacy initiatives, periodically reviewing Web Security and making sure that every UDispatch employee is aware of Our security practices.


    Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, UDispatch cannot guarantee the security of any information You transmit to Us, and You provide us with Your Personal Information at Your own risk. UDispatch expressly disclaims any liability that may arise should any other individuals obtain the information You submit to the UDispatch Platform.     If You believe Your Personal Data has been compromised, please contact Us at [email protected]. If We learn of a security systems breach, We will notify You electronically so that You can take appropriate protective steps. We may also post a notice through the Service if a security breach occurs.


    Your UDispatch profile is password-protected so that only You and authorized UDispatch employees have access to Your account information. If You registered for UDispatch using Facebook Connect, then Your login and password shall be the same as Your Facebook login and password. In order to maintain this protection, do not give Your password to anyone. UDispatch staff will never proactively reach out to You and ask for any Personal Account Information, including Your password. If You share a computer, You should sign out of Your UDispatch account and close the browser window before someone else logs on. This will help protect Your information entered on public terminals from disclosure to Third Parties.


    UDispatch has security measures in place to protect against the loss, misuse and alteration of the information under Our control. Your information may be transferred to and maintained on computer networks which may be located outside of the state, province, country or other governmental jurisdiction in which You reside, and the country or jurisdiction in which these computer networks are located may not have privacy laws as protective as the laws in Your country or jurisdiction.


    The UDispatch Platform may contain links to other websites. We are of course not responsible for the privacy practices of other web sites. We encourage Our Users to be aware when they leave the UDispatch Platform to read the privacy statements of each and every website that collects personally identifiable information before using them.


    This Privacy Policy applies solely to information collected by the UDispatch Platform.


    Information Retention


    To preserve the integrity of Our databases, standard procedure calls for Us to retain information submitted by members for an indefinite length of time. UDispatch understands Your submissions as consent to store all Your information in one place for this indefinite length of time, if We so wish. If required by law, as is the case to comply with the Children's Online Privacy Protection Act (COPPA), We will nullify member information by erasing it from Our database. We will also respond to written member requests to nullify account information. Also, by using the UDispatch Platform, You do hereby represent and warrant that You understand and agree that all information submitted by You through the UDispatch Platform or otherwise to UDispatch becomes the property of UDispatch and may be used in the sole discretion of UDispatch in accordance with this Privacy Policy and the Terms and Conditions.


    Data Transfer


    We may transfer, process and store Personal Data We collect through the Services in centralized databases located in the U.S. The U.S. may not have the same data protection framework as the country from which You may be using the Services. When We transfer Personal Data to the U.S., We will protect it as described in this Privacy Policy. We will comply with applicable legal requirements providing adequate protection for the transfer of Personal Information from Europe to the U.S.


    Changing Our Privacy Policy for Previously Gathered Information


    If at any point We decide to use a specific personally identifiable information in a manner materially different from what is stated in the Privacy Policy at the time it was collected, We will notify Users by way of an email or by providing a 30 day notice on the UDispatch Platform. We also encourage You to review this Privacy Policy periodically for any updates or changes.


    By using the UDispatch Platform, You do hereby represent and warrant that You have read, understand and agree to all Terms of Agreement. Each time You use the UDispatch Platform, You agree to all Terms set forth in this Agreement and any other policies published by UDispatch on the UDispatch Platform. Please note that We will continue to have the right to change Our Privacy Policy and practices, and how We use Your personally identifiable information, without notice, as described herein, provided that such changes shall only apply to information gathered on or after the date of the change. The following types of cookies are used in the Site:


    Strictly Necessary/Essential Cookies: These cookies are essential in order for You to move around the website and use its features, such as accessing secure areas of the website. Without these cookies, the services You request for cannot be provided. These cookies don’t collect information that identifies a visitor.


    Performance Cookies: These cookies collect information about how visitors use a website; for instance, which pages visitors go to most often, and if they get error messages from web pages. The information these cookies collect are aggregated and therefore anonymous, and is used to improve how a website works. These cookies do not collect information that identifies a visitor.


    Functionality Cookies: These cookies allow the website to remember choices You make (such as Your user name, language or the region You are in), and provide enhanced, more personal features. For instance, a website may be able to provide You with local weather reports or traffic news by storing in a cookie the region in which You are currently located. These cookies can also be used to remember changes You have made to text size, fonts and other parts of web pages that You can customize. They may also be used to provide services You have asked for such as watching a video or commenting on a blog. The information these cookies collect may be anonymized and cannot track Your browsing activity on other websites.


    Behaviorally-Targeted Advertising Cookies: These cookies are used to deliver advertisements more relevant to You and Your interests. They are also used to limit the number of times You see an advertisement as well as help measure the effectiveness of the advertising campaigns. They are usually placed by advertising networks with the website operator’s permission. They remember that You have visited a website and this information is shared with other organizations such as advertisers. Quite often targeting or advertising cookies will be linked to site functionality provided by the other organization.


    “Automatically Collected" Information: When You use the Service, We may automatically record certain information from Your device by using various types of technology, including “clear GIFs” or “web beacons.” This “automatically collected" information may include Your IP address, other device address or ID’s, web browser and/or device type, the web pages or sites that You visit just before or just after You use the Service, the pages or other content You view or otherwise interact with on the Service, and the dates and times that You visit, access, or use the Service. We may also use these technologies to collect information regarding Your interaction with email messages, such as whether You opened, clicked on, or forwarded a message. This information is gathered from all users.


    Third Party Web Beacons and Third Party Buttons: We may also implement Third Party content or advertising on the Service that may use clear GIFs or other forms of web beacons, which allow the Third Party content provider to read and write cookies to Your browser in connection with Your viewing of the Third Party content on the Service. Additionally, We may implement Third Party buttons (such as Facebook “like” or “share” buttons) that may allow Third Parties to collect information about You through such Third Parties’ browser cookies, even when You do not interact with the button. Information collected through web beacons and buttons is collected directly by these Third Parties, and UDispatch does not participate in that data transmission. Information collected by a Third Party in this manner is subject to the Third Party’s own data collection, use, and disclosure policies.


    You may opt-out from sending navigation information about Your visit to the Site to Google Analytics by using the Google Analytics Opt-Out page.


    How to Edit Your Information


    UDispatch provides You with the ability to access and edit Your Personal Information. To update Your Personal Information, login on Our Site then click Settings in the UDispatch menu. There You can view, update and correct Your Personal Data provided through the Services. Further, We provide You with the ability to correct inconsistencies of or to update Your information. At Your request, We will have any reference to You deleted or blocked in Our database.


    In order for Us to protect the integrity of sensitive data, there are certain pieces of information, such as Your age, that You cannot alter Yourself.


    Our databases automatically update any Personal Information You edit in Your profile, or that You request We amend. Information transmitted through boards, chats, polls or through any other means remain in Our databases and become the property of UDispatch upon submission. Keep this in mind if You decide to communicate Personal Information through any of these applications.


    Choice/Opt-Out


    UDispatch provides Users the opportunity to opt-out ("Opt-Out") of receiving communications from Us and Our partners at the point where We request information about the visitor. UDispatch gives Users the option to remove their information from Our database, to not receive future communications or to no longer receive Our service.


    Special Cases in Which We Share Personal Information


    Your Personal Information may be passed on to a Third Party in the event of a transfer of ownership or assets, or a bankruptcy.


    We may also disclose Personal Information when We determine that such disclosure is necessary to comply with applicable law, to cooperate with law enforcement or to protect the interests and safety of UDispatch and visitors to the UDispatch Platform.


    We may also disclose Your Personal Information to Our subsidiary and parent companies and businesses, Shippers, Carriers, website and application developers, hosting companies, maintenance, and other services, as well as other affiliated legal entities and businesses with whom We are under common corporate control.


    We also reserve the right to disclose Your information that We believe, in good faith, is appropriate or necessary to (i) take precautions against liability, (ii) protect Ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend Ourselves against any Third Party claims or allegations, (iv) protect the security or integrity of the Service and any facilities or equipment used to make the Service available, or (v) protect Our property or other legal rights (including, but not limited to enforcement of Our agreements), or the rights, property, or safety of others.


    Whenever Personal Information is disclosed under the terms of the above paragraph, We may also disclose Your Demographic Information along with it, on a non-anonymous basis. All of Our parent, subsidiary, and affiliated legal entities and businesses that receive Your Personal Information or non-anonymous Demographic Information from Us will comply with the terms of this Privacy Policy with respect to their use and disclosure of such information.
